Civil Service Law No. (24) of 1960

Chapter One
General Provisions and Definitions

Article (1):

  1. The provisions of this Law shall apply to all civil servants and employees working in government departments whose salaries are paid from the State’s general budget or from the budget of the Public Endowments, as well as to employees of local administrations. These provisions shall not apply to military officers and soldiers, subject to the regulations stipulated in the special laws governing other services and the supplementary provisions relating to the foreign service attached to this Law.

This Law shall apply to the Ministry of Higher Education and Scientific Research (hereinafter referred to as “the Ministry”), its administrative formations, and its affiliated educational and research institutions.

Exam Instructions 2023<br />

Examination committees

The examination committee is one of the most important committees formed in colleges and institutes to manage and document examinations.

The outputs of the educational process and its operation reflect the level of organization in the administrative work of the educational institution.

Her work must be characterized by complete confidentiality, high accuracy, and quality of performance, as this is the fundamental standard for measuring performance.

The level of outputs of the teaching process and documentation of the fruits of the efforts of those targeted by it, namely the students and the governorate.

Regarding their rights, the work of these committees focuses on three main areas:

The first axis: Handling, securing, and maintaining the confidentiality of printing, withdrawing, and storing exam questions.

Second axis: Handling and recording grades on examination books and master sheet records

Third axis: Details of exam results, announcement, objections, auditing.

Regulations for establishing colleges and scientific departments in universities and the Technical Education Authority<br />

The four pillars of higher education are: the faculty, the student, the curriculum, and the necessary educational resources (such as buildings, laboratories, and libraries). Therefore, establishing any college or academic department requires careful preparation by providing all the necessary material and human resources so that the unplanned establishment does not become a burden. The following matters must be taken into consideration when starting the establishment process:

1- It is necessary for each university to have a specialization in the disciplines it includes, and it is not permissible for each university to be a carbon copy of each other. It is also necessary for universities to strive to create new scientific disciplines that do not exist in the country.

Instructions for Scientific Leave No. 162 of 2009<br />

Based on the provisions of Clause (Fourth) of Article (9) of the University Service Law No. (23) of 2008,
we have issued the following instructions:

Article (1)

First, the Minister of Higher Education and Scientific Research may approve sabbatical leave for professors, associate professors, or lecturers within Iraq, in accordance with the law.
Second, the Minister may approve sabbatical leave for those covered by the provisions of paragraph (First) of this article outside the Republic of Iraq if the requirements for sabbatical leave cannot be fulfilled within Iraq.

Examination Instructions No. 134 of 2000<br />

Article 8 – Fourth: If a student succeeds in all subjects in the academic stage he is in and fails some of the subjects he carried over from a lower grade, he will be promoted to the higher grade and will remain carrying over the subjects he failed in the following year, even if he succeeds in the subjects of the higher grade.

Article -9- A student is considered to have failed any subject if his absences exceed (10%) ten percent of the hours allocated for that subject without a legitimate excuse or (15%) fifteen percent with a legitimate excuse approved by the College or Institute Council.

Eighth Amendment to the Ministry of Higher Education and Scientific Research Law No. (40) of 1988<br />

Article (1)
The text of Article (2) of the Ministry of Higher Education and Scientific Research Law No. (40) of 1988 shall be repealed and replaced by the following:
Article (2) This law aims to:
1- Bring about quantitative and qualitative changes in the scientific, technical and cultural movement and direct educational and research institutions in a way that achieves continuous interaction between thought and practice towards achieving originality and scientific rigor and interaction with human experiences and expertise and adopting international scientific quality standards and higher levels of educational development in order to build new generations that carry the banner of science and knowledge to be an active and influential force in society.

First Amendment to the University Service Law No. (23) of 2008<br />

First: University employees shall be retired upon reaching the age of sixty-five (65).
Second: The Minister may extend the service of a professor holding a rare specialization, exempting them from the age requirement, upon the recommendation of the University Council and with the endorsement of the relevant medical committee.
Third: A retiree who does not return to their position in accordance with the provisions of this law shall not be entitled to the privileges stipulated herein and shall continue to receive their pension.

Second Amendment to the University Service Law No. (23) of 2008<br />

Article (1) amends first, second, third and seventh paragraphs of Article (1) of the First Amendment to the University Service Law No. (23) of 2012 and replaces them with the following:

First: The university service employee shall be referred to retirement upon reaching the age of (65) sixty-five years, and the age of (70) seventy years for those who have obtained the academic title of Professor or Assistant Professor. The University Council or Authority may extend the university service for a period not exceeding (5) years for those who are at the rank of Professor or Assistant Professor, as needed, based on his written request and with the recommendation of the College or Institute Council and the endorsement of the competent medical committee.

Second: A retiree who retired on or after January 1, 2005, and did not return to their position in accordance with the provisions of this law, shall be entitled to the privileges stipulated herein and shall continue to receive their pension.
Sixth: A university service employee shall be granted a fixed financial reward of (4,000,000) four million dinars for each research paper published in journals with an impact factor (known internationally as a measure of journal rigor).

Amending the Civil Service Law No. (24) of 1960, as amended<br />

The Presidential Council, in its session held on 11/8/2009, decided
to issue the following law:

amending the Civil Service Law
No. (24) of 1960 as amended

Article 1 – The text of Article (Fifty) of the Civil Service Law No. (24)
of 1960, as amended, shall be repealed and replaced by the following:
Article Fifty
First – A – The competent minister or the head of the entity not affiliated with a ministry may grant an employee who holds a primary or higher university degree and has completed (2) years of actual job service after the last degree, a study leave outside Iraq with all the salary and fixed allowances he receives to obtain a higher degree for the period required for study and language learning in accordance with the conditions approved for scholarship students.

Law No. (163) of 2010, Instructions for the Second Amendment to the Instructions for Supporting Arab Research No. (51) of 1992<br />

Instructions for the second amendment to the instructions for supporting Arabic research No. (51) of 1992

Based on the provisions of paragraph (2) of Article (47) of the Ministry of Higher Education and Scientific Research Law No. (40) of 1988,
we have issued the following instructions:

Article (1)
The text of Article (4) of the Instructions for Supporting Scientific Research No. (51) of 1992 shall be repealed and replaced by the following:

Article (2)
First: The research shall be evaluated by specialized committees within the college or institute, comprised of experts, each of whom shall receive a reward of (100,000) one hundred thousand dinars.
Second: The researcher shall be granted research support fees as follows:
a) (500,000) five hundred thousand dinars for original applied research.
b) (400,000) four hundred thousand dinars for valuable applied research. 

Law No. (148) of 2002 concerning the structure of the researcher's work in the Scientific Research Center and research units in the Ministry of Higher Education and Scientific Research<br />

Article (1) For the purposes of these instructions, the following expressions shall have the meanings assigned to them.

First – Scientific Research Center: An entity responsible for scientific research, affiliated with the university president, and staffed by a group of research faculty members and part-time instructors.
Second – Research Unit: An entity responsible for scientific research, affiliated with the college dean, and staffed by a group of research faculty members and part-time instructors.
Third – Research Faculty Member: A university faculty member employed by the Scientific Research Center or Research Unit.
Article (2) defines the duties of a research faculty member in the Scientific Research Center or Research Unit as follows:
First – Conducting scientific research and studies assigned to the center or unit within its scientific and research plans, individually or as part of research teams, according to the center’s or unit’s operational requirements.
